Terms of Service

1. Acceptance of Terms

By accessing or using TomeForger ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and continued use of the Service constitutes acceptance of any changes.

2. Description of Service

TomeForger is a creative writing and worldbuilding platform that provides tools for authors, game masters, and storytellers. The Service includes but is not limited to:

• Manuscript writing and chapter management
• Character creation, worldbuilding, and lore documentation
• Plot boards, storyboards, and timeline tools
• TTRPG campaign tracking and session management
• Companion pet system, achievements, and gamification
• AI-powered writing assistance (ForgeGuide)
• Collaboration, messaging, and sharing features
• Education accounts for schools and classrooms
• Asset library and marketplace
• Optional integrations such as Google Drive backups and Google Calendar syncing

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 13 years old to create an account. Users between 13 and 18 should have parental or guardian consent. Education accounts with minors must be managed by authorized school administrators.

4. Intellectual Property & Content Ownership

You retain full ownership of all creative content you create on TomeForger. This includes manuscripts, characters, worldbuilding elements, plot structures, campaign notes, uploaded images, and all other original works.

By using the Service, you grant TomeForger a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing and improving the Service. We will never sell, redistribute, or use your creative content for purposes outside of delivering the Service to you.

TomeForger and its logos, design, and platform code are the intellectual property of TomeForger. You may not copy, modify, or distribute any part of the platform itself.

5. Subscription Plans & Payments

TomeForger offers multiple subscription tiers including free and paid plans. Paid subscriptions are billed on a recurring basis through Stripe. By subscribing to a paid plan, you authorize us to charge the applicable fees to your payment method.

• Subscriptions auto-renew unless cancelled before the next billing cycle.
• You may upgrade, downgrade, or cancel your subscription at any time through your account settings.
• Refunds are handled on a case-by-case basis. Contact support for refund requests.
• Education and school plans have separate pricing and seat-based billing.

5-Day Trial Terms

TomeForger may offer eligible users a one-time 5-day trial. The trial allows access to available non-admin and non-tester project types during the trial period. Each email address may only be used for one 5-day trial. Creating additional accounts, changing account details, or attempting to bypass the one-trial-per-email limitation is not permitted.

At the end of the 5-day trial period, trial access will expire and you will be prompted to choose a subscription tier to continue using TomeForger. Any projects or content created during the trial may remain associated with your account, but continued access to certain features or project types may depend on the tier you select after the trial ends. TomeForger may modify, pause, or discontinue trial offers at any time, subject to any active trial access already granted.

6. Acceptable Use

You agree not to use the Service to:

• Upload, share, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to the Service or other users' accounts
• Disrupt or interfere with the Service's infrastructure or other users' experience
• Use automated tools (bots, scrapers) to access the Service without permission
• Resell, sublicense, or commercially exploit the Service without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

7. AI-Powered Features

TomeForger includes AI-powered features such as the ForgeGuide assistant and content generation tools. By using these features:

• You understand that AI-generated content is provided as a creative aid and may not always be accurate or suitable.
• You are responsible for reviewing and editing any AI-generated content before incorporating it into your work.
• Content you submit to AI features may be processed by third-party AI providers, but will not be used to train their models.
• You retain ownership of content you create with the assistance of AI tools.

8. Collaboration & Shared Content

When you share projects or collaborate with other users, you are granting those users access to view or edit content as defined by the permissions you set. You are responsible for managing access to your shared content. TomeForger is not responsible for actions taken by collaborators on shared content.

9. Marketplace

The TomeForger Marketplace allows users to browse templates and professional services. Transactions conducted through the Marketplace are subject to the following:

• Sellers are responsible for the accuracy of their listings.
• Buyers should review listings carefully before purchasing.
• TomeForger may facilitate but is not a party to transactions between buyers and sellers.
• Disputes should be resolved between the parties involved, though we may assist where possible.

10. Referral Program

TomeForger may offer a referral program that allows eligible users to invite others to create an account using a referral link or referral code. Referral credit is only earned when the referred user creates an account and successfully signs up for a paid subscription. Free accounts, trial-only accounts, cancelled payments, failed payments, refunded payments, comped accounts, tester accounts, admin-assigned access, or self-referrals do not qualify for referral credit.

Each eligible user may receive credit for a maximum of six (6) qualifying paid referrals per calendar year. Pending referrals do not count as earned credit until the referred user has completed a qualifying paid subscription signup. TomeForger reserves the right to verify referral activity, deny or revoke referral credit, and suspend participation in the referral program if we detect abuse, fraud, duplicate accounts, self-referrals, payment manipulation, or other activity that violates these Terms.

Referral program terms, rewards, eligibility rules, and availability may be changed, paused, or discontinued at any time at TomeForger's discretion. Referral credits have no cash value unless expressly stated and may not be transferred, sold, or exchanged outside of the referral program.

11. Education Accounts

School and education accounts are subject to additional terms:

• School administrators are responsible for managing student accounts within their institution.
• Student data is protected and isolated within the school account scope.
• Schools agree to comply with applicable education privacy laws (such as FERPA and COPPA where applicable).
• Education pricing and features may differ from individual subscriptions.

12. Data Backups & Google Integrations

Your primary data is stored and maintained on the Base44 platform, which serves as the authoritative source for your content. TomeForger may also offer optional integrations with third-party services, including Google Drive and Google Calendar.

Google Drive:

TomeForger may allow you to create and manage optional secondary backups of your content in your own Google Drive account. These backups are provided as an additional convenience and redundancy feature. You are responsible for configuring and maintaining your Google Drive backup settings and access permissions.

Google Calendar:

TomeForger may allow you to connect your Google Calendar to create, update, or manage events such as writing deadlines, goals, reminders, meetings, or project-related schedule items. You are responsible for reviewing synced events and maintaining your connected calendar settings.

By using these integrations, you acknowledge that:

• Base44 remains the primary source of record for your content unless otherwise stated.
• Google Drive backups and Google Calendar syncing depend on third-party services outside our control.
• We are not liable for data loss, sync failures, duplicate events, missed reminders, access interruptions, or other issues caused by technical failures, user error, third-party outages, revoked permissions, or changes made by Google or other external providers.
• We recommend maintaining your own additional backups of important creative works and reviewing synced calendar events for accuracy.

13. Limitation of Liability

TomeForger is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

14. Termination

You may terminate your account through your subscription manager or by contacting support. We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
